TERMS AND CONDITIONS FOR ENTRY TO MARVELOUS EUROPE'S T-SHIRT PRIZE DRAW FOR SILENT HOPE

1. The Promoter

The Promoter is: Marvelous Europe Limited (company no. 08013642) whose registered office is at: 1st Floor, 2 Baker’s Yard, Farringdon, London, EC1R 3DD, United Kingdom.

2. The Competition

2.1 The title of the competition is the Silent Hope Demo T-shirt Giveaway.

2.2 The Competition is a prize draw for those who have entered by creating and posting a social media post on Twitter.com mentioning @MarvelousEurope and the hashtag #SilentHope , subject at all times to the eligibility criteria below at paragraph 4.

2.3 No purchase necessary and there is no charge to enter the Competition.

3. Competition Period and how to enter

3.1 The Competition will run from 15:00 (PM) British Summer Time on 15 September 2023 (the "Opening Date") to 11:59 (AM) British Summer Time on 2 October 2023 (the "Closing Date") inclusive.

3.2 All Competition entries must be made via the social media platform Twitter.com and be received by the Promoter by no later than 11:59am (BST) on the Closing Date. Any competition entries received after the Closing Date are ineligible and are automatically disqualified.

3.3 The Promoter will not accept responsibility for competition entries that are lost or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.4 By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.

3.5 Each qualifying entry will be assigned a unique number in the order of receipt of the entry. Following the Closing Date, the Promoter will draw a random number (within the parameters of the number of entries received) through the use of a computer-generated random number program located at https://www.google.com/search?q=random+number+generator and the entry number that bears the same number as the number produced by the random number generated will be the winner. There will be 7 winners of the prize as described at paragraph 5.1. The odds of winning will depend on the number of entries received.

4. Eligibility

4.1 The competition is only open to residents in the countries listed in paragraph 4.2 and who are aged 16 years or over at the date of entry, except:

a) employees of the Promoter, Marvelous USA, Inc and their respective holding companies;

b) employees of agents or suppliers of the Promoter or Marvelous USA, Inc or their respective holding companies, who are professionally connected with the competition or its administration; or

c) members of the immediate families or households of (a) and (b) above. “Immediate families” means spouses, partners, parents, legal guardians, in-laws, grandparents, siblings, children, and grandchildren. “Households” means people who share the same residence at least three months a year, whether legally related or not.

4.2 The list of eligible countries are as follows:

Albania, Andorra, Armenia, Austria, Australia, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Moldova, Monaco, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, San Marino, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey and United Kingdom, and is void where prohibited by law.

4.3 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. If you are the winner, the Promoter may require you to provide proof that you are eligible to enter the competition (whether by age or country of residence) before sending the prize. If you are aged 16 or 17, you should have a parent or guardian’s permission to enter.

4.4 The Promoter will not accept Competition entries that are:

a) automatically generated by computer;

b) completed by third parties or in bulk; or

c) incomplete.

4.5 In entering the competition you understand that you must be following the Promoter's social media profile at the time of the Winner draw. The account can be found on Twitter/X at https://twitter.com/marvelouseurope.

4.6 There is a limit of one entry per person and entrants must not attempt to enter more than once. The Promoter has the right, in its sole discretion, to maintain the integrity of the Competition, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to damage the Competition Website or undermine the legitimate operation of the Competition may be a violation of criminal and civil laws. Should such an attempt be made, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

4.7 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

4.8 The Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Competition should any virus, bug, non-authorised human intervention, fraud, or other cause beyond the Promoter’s control corrupt or affect the administration, security, fairness, or proper conduct of the Competition. In any such case, the Promoter may select a winner from eligible entries received before and/or after the action taken by the Promoter if appropriate. The Promoter reserves the right at its sole discretion to disqualify any entrant who tampers or attempts to tamper with the entry process or the operation of the Competition or Competition Website or otherwise breaches these Terms & Conditions.

5. The prize

5.1 The prize is a total of 7 T-shirts branded with Silent Hope artwork, to be distributed 1 per winner.

5.2 There is no cash alternative for the prize.

5.3 The Promoter reserves the right to replace any element of prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.

5.4 The prize is not negotiable or transferable.

6. Winner

6.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

6.2 The Promoter will contact the winner within 7 days of the selection of the winning entry, using the Direct Message function on Twitter.com. The Promoter shall have no liability for a Winner's failure to receive notices due to either the Promoter’s message being designated as spam/junk or as a result of other security settings or for the winner having provided incorrect or otherwise non-functioning contact information.

6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and country of the winner to anyone who emails community@maqleurope.com within one month after the Closing Date.

6.4 If as winner you object to any or all of your surname and country being made available, please contact the Promoter at community@maqleurope.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request and to any other country-specific advertising regulator upon such request.

7. Claiming the prize

7.1 If you are the winner of the prize, you will have 7 days from the date upon which the Promoter contacts you using the Direct Message function on Twitter to claim the prize. If you fail to respond by this date, your claim will become invalid.

7.2 The prize may not be claimed by a third party on your behalf.

7.3 The Promoter will make one attempt to contact the winner, as set out in paragraph 6.2. If the winner cannot be contacted or has not claimed the prize within 7 days of the date that the Promoter contacts them confirming their win, the Promoter reserves the right disqualify the winner and re-run the random number generation process to identify a replacement winner.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Receipt of the prize offered in this Competition by the winner is conditional upon compliance with any and all federal, state, and local laws and regulations.

8. Limitation of liability

8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. The Promoter shall not be liable for any liability connected with the disqualification of any entry designated as winner but for which it is subsequently discovered that the winning entry is ineligible. Additionally, the Promoter shall not be liable for liability arising out of any (i) unauthorised human intervention in any part of the Competition; (ii) electronic or human error in the administration of the Competition or the processing of entries; (iii) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iv) the unavailability or inaccessibility of any transmissions, telephone, or internet service; (v) lost, late, postage due, misdirected, or undeliverable mail or packages. Your statutory rights are not affected.

9. Data protection and publicity

9.1 The Promoter will only process your personal information as set out in the privacy policy at https://marvelousgames.com/privacy-policy. See also paragraph 6.4 and paragraph 6.5, with regard to the announcement of winners.

10. General

10.1 The Competition is in no way sponsored, endorsed or administered by Twitter or any other social networks that are used to share the Competition. You understand that you are providing your entry information to the Promoter and not to Twitter or any other social networks.

10.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter, at its sole discretion, reserves the right to exclude you from participating in the Competition.

10.3 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

10.4 The Competition and these terms and conditions are governed by the laws of England and Wales. Any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the English courts unless otherwise required by mandatory local law. For example, for residents of France, Germany, Finland, Spain and the Netherlands, the Competition is governed by the applicable local law (for example, French law for residents of France, German law for residents of Germany, etc.) and subject to the exclusive jurisdiction of the appropriate local courts (for example, French courts for residents of France, German courts for residents of Germany, etc.).

10.5 If any provision of these terms and conditions are found by a court of competent jurisdiction to be invalid, it is nevertheless agreed that the other provisions will remain in full force and effect.
